How the arrangement works
The agency's fee is a percentage of what it recovers. When a debtor pays, the fee is deducted and the balance is remitted to you on the regular schedule. When a debtor does not pay, there is nothing to deduct from, and nothing is billed. Our commission comes out of what we collect, never out of your pocket.
What it covers
- Daily phone contact and demand letters.
- Skip tracing to locate the debtor and any assets, bank accounts, and property.
- Settlement negotiation and dispute resolution.
- Referral to an attorney near the debtor, a demand on law firm letterhead, and a legal case evaluation.
- A clear recommendation to close or to litigate, and closing at no cost when recovery is unlikely.
- 24/7 online access to every account and reports in the format you want.
What it does not automatically cover
Litigation costs. If you authorize a lawsuit, suit fees such as court filing costs are usually advanced by the client and typically reimbursed once a judgment is collected. You decide whether to sue; if you decline, you owe nothing.
Unusual cases. For very low balances, complex international claims, or cases requiring significant legal resources, an alternative fee arrangement may be discussed with you up front, with full transparency before any commitment.
Why agencies can work this way
Because it lines up the agency's interest with yours. The agency is paid when you are paid, so it has every reason to work the account hard, and every reason to tell you honestly when a file should be closed instead of churning it. An agency that bills by the hour has neither.
What to ask any agency that offers it
- Is the rate confirmed in writing before I sign?
- How are payments the debtor makes directly to me after placement handled?
- Who advances litigation costs, and how are they reimbursed?
- When is recovered money remitted, and can I see each account online?
Common follow-up questions
Is the free consultation really free?
Yes. Tell us about the accounts and we put together a free assessment, usually within one business day. There is no charge and no obligation.
Do I owe anything if I decide not to sue?
No. If litigation is recommended, the decision is yours. Decline and you owe nothing.
What if the debtor pays me directly after I place the account?
Report it to us immediately; it is illegal for us to keep collecting on a paid claim. How direct payments are treated is spelled out in the agreement you sign, so ask before you sign if anything is unclear.
